1. Agreement to Terms

By accessing or using BulkQR.io ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

BulkQR.io provides a web-based platform for generating, customizing, and managing QR codes, including bulk QR code generation capabilities. Our Service includes:

• Single and bulk QR code generation
• QR code customization and styling options
• QR code management and history
• Template creation and management
• Dynamic QR codes with tracking capabilities (on applicable plans)
• CSV upload and batch processing
• Download and export functionality

3. Account Registration and Eligibility

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms or engaged in fraudulent or illegal activity.

4. Subscription Plans and Billing

4.1 Subscription Tiers

BulkQR.io offers multiple subscription plans:

By subscribing to a paid plan, you agree to:

• Pay all fees associated with your chosen subscription plan
• Provide valid payment information through our payment processor (Stripe)
• Authorize recurring monthly charges to your payment method
• Accept that all fees are in GBP (£) and are non-refundable except as required by law

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or customer portal. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• Your subscription will not renew for the next billing period
• No refunds will be provided for partial subscription periods
• You may resubscribe at any time

4.5 Price Changes

We reserve the right to change our pricing at any time. If we increase the price of your subscription, we will notify you at least 30 days in advance, and the new price will apply at your next renewal.

5. Acceptable Use Policy

5.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• To create QR codes that link to illegal, fraudulent, or harmful content
• To violate any applicable laws or regulations
• To infringe upon the intellectual property rights of others
• To distribute malware, viruses, or malicious code
• To engage in phishing, spam, or other deceptive practices
• To harass, abuse, or harm another person or entity
• To impersonate any person or entity
• To circumvent any security features of the Service
• To create QR codes that promote hate speech, violence, or discrimination
• To scrape, copy, or otherwise exploit the Service without authorization

5.2 Content Responsibility

You are solely responsible for the content of the QR codes you generate and the destinations to which they link. We do not monitor or control the content encoded in your QR codes, but we reserve the right to:

• Review QR code content if we receive complaints or notice violations
• Remove or disable access to QR codes that violate these Terms
• Suspend or terminate accounts that repeatedly violate these Terms
• Report illegal activity to appropriate authorities

5.3 CSV Uploads and Personal Data

When using bulk QR code generation features with CSV uploads, you acknowledge and agree that:

• You are the Data Controller (under GDPR) for any personal information in your CSV files
• You have obtained all necessary consents, permissions, or legal basis to process the personal data
• You comply with all applicable data protection laws (GDPR, UK DPA 2018, etc.)
• You will not upload personal data of individuals without proper legal authorization
• You are responsible for the accuracy and lawfulness of all uploaded data
• You will provide appropriate privacy notices to individuals whose data you process
• BulkQR.io acts solely as a Data Processor, processing data only according to your instructions

5.4 Usage Limits

Your subscription plan includes specific usage limits for QR code generation, storage, and other features. You agree not to exceed these limits or attempt to circumvent them through multiple accounts or other means.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its original content (excluding user-generated QR codes), features, and functionality are owned by BulkQR.io and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your QR Codes

You retain all rights to the content you encode in QR codes and the QR codes themselves that you generate using our Service. By using our Service, you grant us a limited license to:

• Store and process your QR codes to provide the Service
• Display your QR codes to you through our platform
• Create backups for service reliability

We will not use your QR codes for any other purpose without your explicit consent.

6.3 Trademark Usage

BulkQR.io, our logo, and any other product or service names displayed on the Service are trademarks of BulkQR.io. You may not use these trademarks without our prior written permission.

7. Service Availability and Modifications

7.1 Service Availability

We strive to maintain high service availability but cannot guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that:

• The Service will meet your specific requirements
• The Service will be available at all times
• All errors or defects will be corrected
• The Service will be free from viruses or other harmful components

7.2 Maintenance and Updates

We reserve the right to perform scheduled and emergency maintenance that may result in temporary service interruptions. We will attempt to provide advance notice of scheduled maintenance when possible.

Your use of the Service is at your sole risk. We do not warrant that your use of the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULKQR.IO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar malicious code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content
• The conduct or content of any third party on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless BulkQR.io and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• The content of QR codes you generate
• Any harm caused by your QR codes or their destinations

11. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

We comply with applicable data protection laws, including the UK GDPR and Data Protection Act 2018.
